User Agreement
1. General
This Agreement governs your use of the Windows on Warwickshire website. Windows on Warwickshire reserves the right, to change or modify all or any part of this Agreement at any time, effective immediately upon notice published on this web site. Your continued use of the web site constitutes your binding acceptance of these Terms and Conditions, including any changes or modifications made by Windows on Warwickshire as permitted above. If at any time the Terms and Conditions of this Agreement are no longer acceptable to you, you should immediately cease all use of this web site.
2. Use of Content
2.1. You acknowledge that the web site contains information and other material (collectively, the "Content") that is protected by copyright, trademark or other proprietary rights of Windows on Warwickshire and third parties. All Content on the web site is copyrighted as a collective work of Windows on Warwickshire pursuant to applicable copyright law. You agree to comply with any additional copyright notices, information, or restrictions contained in any Content available on or accessed through the Windows on Warwickshire web site. Users of the web site may use the Content only for educational, or personal, non-commercial use.
2.2. You may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part, except as expressly permitted in this Agreement.
2.3. You may only download or copy the Content for educational or personal non-commercial use. You shall not store electronically any significant portion of the Content, except as expressly permitted by the copyright laws. No copying, storage, redistribution or publication of any Content is permitted without the express permission of Windows on Warwickshire or the owners of such Content or their authorised persons, if other than Windows on Warwickshire. Educational establishments may copy and re-publish Content electronically, provided that the Content is published only on the establishment’s official network or web site and the source is acknowledged.
3. Use of Historic Mapping
3.1. You must not use the images for financial gain.
3.2. You may download a maximum of 10 images from the site for use on personal web pages providing the following credit appears below all images: Image produced from the Windows on Warwickshire service with permission of Landmark Information Group Ltd. and Ordnance Survey, where Windows on Warwickshire is hyperlinked to http://www.windowsonwarwickshire.org.uk, Landmark Information Group Ltd. is hyperlinked to http://www.landmark-information.co.uk and Ordnance Survey is hyperlinked to http://www.ordnancesurvey.co.uk.
3.3. You may, where the use of the map information is a tool for the day-to-day activities associated with the running of your organisation or where the map information is to be used for teaching purposes :-
- make up to 500 hard copies per year for inclusion in leaflets or private journals provided there is no financial gain by you in respect of publishing the mapping; make electronic transmissions of any graphic image, produced specifically for the purposes of allowing the recipient to produce leaflets or journals including the map image provided there is no direct financial benefit to the recipient;
- pass the mapping information to contractors or agents when undertaking publishing activities on your behalf, providing that you are responsible to Landmark and Ordnance Survey for the acts and omissions of the contractor or agent, and that at the end of the contractor's or agent's use of the mapping the contractor or agent returns the mapping to you and destroys all copies - and providing there is no financial gain by you in respect of publishing the mapping.
3.4. You must:-
- include the correct Copyright acknowledgement as follows :-
Copyright © and/or Database Right Landmark Information Group and Ordnance Survey Crown Copyright and/or Database Right 2002. All rights reserved;
- send Landmark (Customer Services, 7 Abbey Court, Eagle Way, Exeter, EX2 7HY, UK), a copy of any finished publication within 14 days of completion. This excludes teaching material.
3.5. You may not:-
- give other people permission to copy the mapping material in your publications without our written permission;
- sell, resell or exploit for commercial purposes any of the information held on or accessed via this site. This is expressly prohibited.
3.6. Where you wish to undertake any additional activities restricted in the above conditions, please contact us.
4. External Sites
The web site may contain links to sites on the Internet, which are owned and operated by third parties (the "External Sites"). You acknowledge that Windows on Warwickshire is not responsible for the availability of, or the Content located on or through, any External Site. You should contact the site administrator or Webmaster for those External Sites if you have any concerns regarding such links or the Content located on such External Sites.
5. Termination of Service
Windows on Warwickshire reserves the right, in its sole discretion, to restrict, suspend or terminate access to all or any part of the web site, at any time for any reason without prior notice or liability. Windows on Warwickshire may change, suspend or discontinue all or any aspect of the web site at any time, including the availability of any feature, database, or content, without prior notice or liability.
6. Disclaimer of Warranties; Limitations of Liability
6.1. Neither Windows on Warwickshire nor any provider of third party Content or their respective agents warrants that the service will be uninterupted or error free; nor does Windows on Warwickshire, any third party Content provider, or their respective agents make any warranty as to the results to be obtained from use of the service or the content. The service and the content are distributed on an "as is, as available" basis. None of Windows on Warwickshire, third party Content providers and their respective agents make any warranties of any kind, either expressed or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose, with respect to the service. Neither Windows on Warwickshire nor any third party Content provider warrants that any files available for downloading through the service will be free of viruses or similar contamination or destructive features. You expressly agree that the entire risk as to the quality and performance of the service and the accuracy or completeness of the Content is assumed solely by you.
6.2. Neither Windows on Warwickshire, any third party content providers nor their respective agents shall be liable for any direct, indirect, incidental, special or consequential loss arising out of the use of, or inability to use, the web site, even if such party has been advised of the possibility of such damages.
6.3. In countries and sovereign states which do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, the above limitations or exclusions may not apply to you. In such cases, the liability of Windows on Warwickshire , third party content providers and their respective agents shall be limited to the greatest extent permitted by law.
7. Miscellaneous
This Agreement shall be construed in accordance with the laws of the England and Wales, and the parties irrevocably consent to bring any action to enforce this Agreement in the English courts. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. If any inconsistency exists between the terms of this agreement and any additional terms and conditions posted on the web site, such terms shall be interpreted as to eliminate any inconsistency, if possible, and otherwise, the additional terms and conditions shall control.
